New Delhi; April 2026<\/strong>: In a major legislative setback for the government, the Constitution (131st Amendment) Bill, 2026, which sought to implement women’s reservation starting from the 2029 general elections, was defeated in the Lok Sabha today (17th April 2026).<\/p>\n\n\n\n

The defeat has triggered a wave of political manoeuvring, with Leader of Opposition Rahul Gandhi reaching out to TMC General Secretary Abhishek Banerjee to consolidate the opposition’s stance. Following the results, high-level communication between the Congress and the Trinamool Congress (TMC) signalled a victory for the united opposition front. Sources within the AITC confirmed that Rahul Gandhi held a telephonic conversation with Abhishek Banerjee shortly after the session.<\/p>\n\n\n\n

“After the Bill was defeated, Rahul Gandhi called Abhishek Banerjee to thank him for playing a crucial role in defeating this Bill”, a top AITC source stated. The opposition’s primary contention has been centred on the delay of the reservation until 2029 and its linkage to the controversial Delimitation Bill, which many parties argue would unfairly penalise states that have successfully managed population growth.<\/p>\n\n\n\n

The collapse of the 131st Amendment led to the immediate stalling of the government’s broader legislative agenda for the day. Parliamentary Affairs Minister Kiren Rijiju announced that the government would no longer pursue the two related pieces of legislation, the Union Territories Laws (Amendment) Bill, 2026 and the Delimitation Bill, 2026. The Delimitation Bill, in particular, had been a flashpoint of contention, with the BJP asserting it would dismantle “dynastic politics” while the opposition viewed it as a tool for political gerrymandering. The defeat underscores the rigorous nature of amending India’s founding document. Beyond the two-thirds requirement in both Houses of the Parliament, any amendment affecting the representation of states, as the Women’s Reservation and Delimitation bills do, would also have required ratification by at least half of the State Legislatures.<\/p>\n\n\n\n

In the division that took place following the debate on the three bills, 298 members supported the bill while 230 voted against it. Lok Sabha Speaker Om Birla announced the results of the division. “The Constitution (131st Amendment) Amendment Bill did not pass as it did not achieve a 2\/3 majority during voting in the House”, he said.<\/p>\n\n\n\n

Immediately after his telecon with AITC General Secretary Abhishek Banerjee, LoP Rahul Gandhi said that the Opposition has “defeated this attack on the Constitution” after the Women’s Reservation<\/p>\n\n\n\n

Amendment Bill failed to pass in the Lok Sabha. Gandhi said the Bill was not, in his view, a genuine step toward women’s reservation but “a way to change India’s political structure”.<\/p>\n\n\n\n

Speaking to reporters, he said, “We have defeated this attack on the Constitution. We have clearly said that this is not a women’s reservation bill, but it is a way to change India’s political structure”. He further added that the Opposition stands firm on its position and will support any genuine legislation ensuring the immediate implementation of women’s reservation. Gandhi added, “I want to say to PM Modi that if you want the Women’s Reservation Bill, bring the 2023 Women’s Reservation Bill and implement it today. We will give 100% support to you”.<\/p>\n\n\n\n

Reacting to this, Congress MP Mallu Ravi said, “Modi-BJP govt intentionally introduced this bill even when they knew they didn’t have 2\/3 majority. We have so many doubts about the delimitation, and this is why we opposed the bill”.<\/p>\n\n\n\n

Congress MP Dharamvira Gandhi said, “NDA has been defeated on the Women’s Reservation Bill brought under the guise of delimitation and general census. They have created an umbrella of women’s reservation to pursue their agenda of delimitation”.<\/p>\n\n\n\n

After the Lok Sabha did not pass the Constitution Amendment Bill, Parliamentary Affairs Minister Kiren Rijiju said the government had no intention to pursue the two other bills. While motions for the introduction of Constitution Amendment Bills are adopted by a simple majority, a majority of the total membership of the House and a majority of not less than two-thirds of the members present and voting is required for the adoption of effective clauses and motions for consideration and passing of these Bills.<\/p>\n\n\n\n
