Washington, Oct 2025 <\/strong>: The Trump administration is facing its first major domestic legal challenge to its crackdown on the H-1B visa program, as a coalition of unions, education professionals, and religious organizations filed a lawsuit in the Northern District of California. The plaintiffs argue that President Donald Trump\u2019s September 19 proclamation\u2014introducing a $100,000 application fee for new H-1B visas\u2014is riddled with errors, oversteps presidential authority, and undermines America\u2019s economy.<\/p>\n\n\n\n

The lawsuit contends that the proclamation \u201cignores the well-established benefits of the H-1B visa program to the American economy\u201d and labels the steep fee \u201cunprecedented, unjustified, and unlawful.\u201d The plaintiffs argue that by imposing such a penalty unilaterally, Trump has bypassed Congress and effectively rewritten immigration law.<\/p>\n\n\n\n

\u201cNo President has, without Congressional authorization, imposed such a market-wide penalty for alleged misuse of a program,\u201d the complaint states. \u201cThis measure disregards an existing, complex statutory scheme and undermines the very system Congress put in place for employers seeking to hire foreign talent under the H-1B program.\u201d<\/p>\n\n\n\n

The lawsuit also warns that the proclamation\u2019s provision for case-by-case exemptions \u201copens the door to selective enforcement and corruption,\u201d creating uncertainty for employers and workers alike.<\/p>\n\n\n\n

The plaintiffs include a range of immigration and advocacy groups such as the Justice Action Center, South Asian American Justice Collaborative, and Democracy Forward Foundation. Trump, while announcing the measure, framed it as part of his \u201cAmerica First\u201d policy. \u201cThe incentive is to hire American workers. We need great workers, and this pretty much ensures that,\u201d he said.<\/p>\n\n\n\n

Commerce Secretary Howard Lutnick defended the move more bluntly, calling it a deterrent for companies outsourcing jobs. \u201cThese big tech companies train foreign workers and then hire them. With a $100,000 government fee on top of salaries, it\u2019s just not economic anymore. Instead, they\u2019ll have to train American graduates. That\u2019s the policy here,\u201d he explained.<\/p>\n\n\n\n

The proclamation initially caused confusion, raising fears among current H-1B visa holders about their ability to return to the United States. The White House clarified on September 20 that the $100,000 fee applies only to new visas, not renewals or existing visa holders.<\/p>\n\n\n\n
