CJP Founder Abhijeet Dipke Granted Conditional Bail After Detention Ahead of Delhi Flag March

New Delhi, October 2026 : Cockroach Janata Party (CJP) founder Abhijeet Dipke received legal relief on Saturday after a Special Executive Magistrate (SEM) court in Delhi granted him conditional bail following his preventive detention ahead of a proposed protest march in the national capital. According to Delhi Police, the court ordered his release after he signed a peace bond undertaking to maintain public peace.

Dipke was taken into preventive custody on Friday, October 16, ahead of the CJP’s proposed ‘Lehra Do Tiranga’ march in Connaught Place. The party had called for the protest to demand the resignation of Chief Election Commissioner Gyanesh Kumar and raise concerns over alleged controversies surrounding the Special Intensive Revision (SIR) of electoral rolls.

His detention triggered criticism from party leaders, who questioned the legal grounds for the police action and alleged that the move undermined citizens’ democratic rights.

SEM Court Grants Conditional Bail

Dipke was produced before the Special Executive Magistrate’s court on Saturday. During the proceedings, the court considered the circumstances surrounding his detention and the measures required to maintain public peace.

The court granted him conditional bail and directed him to sign the prescribed peace bond. Delhi Police said his release would follow the completion of the required formalities.

The court did not order his transfer to judicial custody in connection with the preventive detention proceedings. The decision brought relief to CJP supporters, who had been demanding his immediate release.

The development, however, did not resolve the wider dispute between the party and the police over the proposed demonstration and the restrictions imposed on public gatherings in central Delhi.

CJP Questions Legality of Detention

Ratna Singh, head of legal affairs for the Cockroach Janata Party, challenged Dipke’s detention and alleged that the police action violated fundamental rights and established legal procedures.

She called for his immediate release, arguing that detaining someone preparing to participate in a peaceful demonstration without sufficient legal grounds was unjustified.

Singh also questioned why preventive detention was necessary when the proposed protest concerned issues that the party maintained fell within the scope of democratic expression.

The police, however, have maintained that their actions were necessary to prevent potential law-and-order problems and maintain public peace.

The contrasting positions have brought renewed attention to the balance between the right to peaceful assembly and the authorities’ responsibility to prevent disturbances.

Dispute Began Ahead of ‘Lehra Do Tiranga’ March

The controversy centres on the CJP’s proposed ‘Lehra Do Tiranga’ march scheduled for Friday in Connaught Place.

The party had announced the demonstration to demand Gyanesh Kumar’s resignation and protest against alleged irregularities and concerns relating to the Special Intensive Revision of electoral rolls.

According to the police, organisers had been issued notices before the proposed march. Authorities said permission had not been granted because prohibitory orders were in force in the relevant area.

Despite the restrictions, groups of protesters reportedly gathered in Connaught Place and nearby locations. Police detained several people and initiated action over alleged violations of the prohibitory orders.

The detentions prompted criticism from CJP supporters and other groups, who argued that peaceful protests should be permitted within the framework of democratic rights.

AISA National President Neha Bora Also Detained

Dipke was not the only political activist detained ahead of the proposed demonstration. Neha Bora, national president of the All India Students’ Association (AISA), was also taken into custody on Friday from the Mandi House area.

Bora was released from preventive detention on Saturday morning.

Following the detentions, student organisations and CJP supporters criticised the police action. They maintained that citizens and political groups should be able to raise demands and organise peaceful demonstrations without unnecessary restrictions.

The police, meanwhile, have cited the need to maintain public order in explaining the preventive measures taken before the planned march.

Dipke Had Also Been Detained on October 11

The latest action was not the first time Dipke had faced preventive detention in connection with a proposed demonstration in Delhi.

On October 11, he and other CJP leaders were detained ahead of another planned protest. At that time, a Special Executive Magistrate ordered the release of Dipke, Saurav Das and Ashutosh Ranka on conditions requiring them to maintain peace for one year.

The three leaders were released after furnishing the prescribed bonds. Following their release, the party announced that it would continue pursuing its demands.

The latest detention and subsequent conditional bail have once again brought the party’s protest campaign and its confrontation with the police into focus.

Debate Over Protest Rights and Public Order

The case has renewed the debate over the constitutional right to peaceful assembly and the restrictions authorities can impose to maintain public order.

Article 19(1)(b) of the Constitution of India guarantees citizens the right to assemble peacefully and without arms. However, Article 19(3) permits reasonable restrictions on this right in the interests of public order and the sovereignty and integrity of India.

The central issue in the present dispute is whether the preventive measures taken by the police were justified by the circumstances surrounding the proposed march.

While Delhi Police has maintained that its actions were intended to prevent a possible breach of peace, the CJP has alleged that preventive detention was used to obstruct political protest.

Dipke’s conditional release on Saturday has provided immediate relief to the party founder, but questions surrounding the police action and the cases registered over alleged violations of prohibitory orders remain unresolved.

Release Follows Peace Bond

Following the court’s order and completion of the required formalities, Dipke was released after signing the peace bond. He was subsequently seen leaving the Karol Bagh residence of CJP spokesperson Anish Gawande.

The political dispute over electoral roll revision and the demand for the Chief Election Commissioner’s resignation continues.

The next developments will depend on the CJP’s response following Dipke’s release and the legal proceedings arising from the alleged violations of restrictions imposed ahead of the proposed march.
