International Court Of Justice Has Amended Article 78 Of The Rules Of Court.

Hague, Netherlands; December 2025: As part of the ongoing review of its procedures and working methods, the International Court of Justice has amended Article 78 of the Rules of Court in order to address the question of the publication of reports of the parties on compliance with provisional measures indicated by the Court.

It is recalled that Article 78 of the Rules of Court currently stipulates that: “The Court may request information from the parties on any matter connected with the implementation of any provisional measures it has indicated”.

The text of Article 78 of the Rules of Court, as amended, will enter into force on 2 February 2026 and will read as follows:

Article 78

1. The Court may request that the parties shall submit reports to it on measures they have taken to give effect to an Order indicating provisional measures, within a time-limit specified by the Court. The Court may also request information on other matters connected with any provisional measure it has indicated.

2. Where the Court requests the submission of a report pursuant to paragraph 1 of this Article, it shall, after ascertaining the views of the parties, make the report or parts thereof accessible to the public as soon as possible, unless, in case of an objection by a party, it decides otherwise”.

The International Court of Justice (ICJ) is the principal judicial organ of the United Nations. It was established by the United Nations Charter in June 1945 and began its activities in April 1946. The Court is composed of 15 judges elected for a nine-year term by the General Assembly and the Security Council of the United Nations. The seat of the Court is at the Peace Palace in The Hague (Netherlands). The Court has a twofold role: first, to settle, in accordance with international law, legal disputes submitted to it by States; and, second, to give advisory opinions on legal questions referred to it by duly authorised United Nations organs and agencies of the system.
