IUSTITIA EUROPA Has Filed War Crimes Complaint Against Israel And Netanyahu.

Madrid; April 2026: The political party Justice Europe (IUSTITIA EUROPA) today (11th April 2026) has filed a criminal complaint with the Spanish National Court (Audiencia Nacional) against Israeli Prime Minister Benjamin Netanyahu and the Chief of Staff of the Israel Defense Forces (IDF), Herzi Halevi, as well as other Israeli commanders and military personnel yet to be identified, for the alleged commission of crimes against persons and property protected in armed conflict, illegal detention, and coercion. These serious events took place on April 7, 2026, in southern Lebanon, directly affecting a Spanish sergeant serving with the United Nations Interim Force in Lebanon (UNIFIL).

The incident, which IUSTITIA EUROPA describes as a deliberate attack and a flagrant violation of international law, occurred when a logistics convoy of the Spanish contingent in UNIFIL was intercepted in a hostile manner by Israeli forces in the Taybeh area. The Spanish personnel were operating under the protection of UN Security Council Resolution 1701 (2006), which requires respect for the security and freedom of movement of UNIFIL. During the interception, a Spanish sergeant was violently removed from his vehicle, illegally detained for approximately one hour, and subjected to physical violence and degrading treatment before being released following intense diplomatic pressure.

Justice Europe emphasises that this act is not an isolated incident but rather part of a pattern of increasing harassment and attacks against UNIFIL peacekeeping personnel in the region, which aggravates the nature of the reported events and demonstrates a systematic disregard for the norms of international law. The complaint filed with the Spanish National Court is based on the jurisdiction of the Spanish courts, invoking the principle of passive personality, as the victim is a Spanish national, and the principle of universal jurisdiction, given that the alleged crimes are serious and are not being effectively investigated in Israel.

The legal classification of these events includes war crimes, pursuant to Article 612 of the Penal Code, which criminalizes attacks against peacekeeping personnel, as well as unlawful detention and coercion. These crimes are consistent with International Humanitarian Law, the Geneva Conventions, and the Rome Statute of the International Criminal Court, which considers the intentional attack against peacekeeping personnel a war crime. The IDF’s actions in intercepting a UNIFIL convoy and assaulting one of its members constitute a direct attack on UN authority and a serious breach of international obligations.

The complaint also addresses the criminal responsibility of the perpetrators and, crucially, that of their superiors. It argues that Prime Minister Benjamin Netanyahu and Chief of Staff Herzi Halevi, as the highest-ranking officers of the Israel Defense Forces, had effective control over the forces involved and, therefore, must be held accountable for the lack of measures to prevent these crimes, as well as for failing to investigate and punish those responsible following Spain’s diplomatic protest. The lack of a proper and transparent investigation by the Israeli authorities reinforces the need for the intervention of the Spanish justice system.

Luis María Pardo stated: “We cannot allow impunity to take root in the international community. The attack and illegal detention of a Spanish soldier, who was fulfilling his duty under the United Nations flag, is a direct affront to Spain’s sovereignty, the authority of the UN, and the most fundamental principles of International Humanitarian Law. The Israeli government, under Netanyahu’s leadership, has demonstrated utter contempt for the lives and safety of peacekeepers. This is not a mistake, but a deliberate policy of harassment aimed at undermining UNIFIL’s mission and operating outside the bounds of any norm”.

Luis Pardo has further asserted that, “The violence perpetrated against our sergeant is not only a criminal act, it is a message of intimidation to the entire international community. The protection of peacekeepers is non-negotiable; it is a fundamental pillar of global stability. We demand a thorough investigation, the identification of all those involved, and the rigorous application of the law. This is not just a case of aggression against a Spanish soldier; it is a defense of the international law and the dignity of those who risk their lives for peace. If the State of Israel believes itself to be above the law, it is the duty of established democracies, such as Spain, to remind it that no one is exempt from criminal responsibility for war crimes”.

The objective is to clarify the facts, determine criminal responsibility, and ensure that attacks against peacekeeping forces and international law do not go unpunished. IUSTITIA EUROPA’s complaint not only seeks justice for the Spanish soldier who was attacked, but also aims to set a clear precedent regarding the responsibility of high-ranking officers in the prevention and punishment of international crimes, reaffirming Spain’s commitment to international law and the protection of its citizens on peacekeeping missions.
