The learned court, while hearing the trial of a case between Bhakat Singh, plaintiff versus a leading insurance company, herein the defendant, had observed that the insurance company is tactically delaying the claim process pledging the suit to be dismissed on the grounds of non-prosecution, since the plaintiff had not appeared before the learned court even for a single instance after the law suit has been filed.

Taking due cognizance, the most learned court, before dismissing the suit on the ground of sufficient justification for non-appearance, adviced the defendant to reach out to the plaintiff, and ascertain his where-abouts & reasons for non-appearance. The defendant – insurance company started looking out for the plaintiff. It was indeed a formidable task, finding a needle in a pile of haystack. The address, was documented several years ago when the law suit was filed, falls within the jurisdiction of the most notorious extremists. Finally, with the aid of a path breaking methodology the plaintiff was traced. While visiting the plaintiff the defendant observed, that the alleged accidental death case was not intimated to the police department; no post mortem was conducted, but the body was cremated as per Local Rituals amidst barren lands for which the plaintiff expressed his inability to furnish any cremation certificate.  

The death certificate was a faustian contract; obtained from the doctor threatened with dire consequences. The doctor had condemned his own act stating it to be a deal with the devil. The defendant managed to obtain a declaration from the plaintiff wherein he stated that the lawsuit was filed by an unknown lawyer, on his behalf, who had assured him to garner a hefty compensation from the insurance company. The case was dismissed, and the claim was repudiated.

While studying the merits of the case, it was evident that if a police complaint was lodged & an autopsy conducted the poor person could have been genuinely compensated.
