Delhi High Court Restrains Priya Kapur from Altering Sunjay Kapur’s Estate in ₹30,000 Crore Inheritance Dispute
New Delhi, April 2026 : The Delhi High Court on Thursday granted interim relief to the two children of late industrialist Sunjay Kapur from his former marriage with Bollywood actor Karisma Kapoor, restraining his widow Priya Kapur from alienating, dissipating, or creating third-party rights over key portions of his estate until the inheritance dispute is finally adjudicated.
The order was passed by a single-judge Bench of Justice Jyoti Singh, who observed that the estate of the deceased must be preserved during the pendency of the suit to ensure that no irreversible changes are made before the court determines the validity of the contested will.
The court noted that the plaintiffs—Samaira Kapur and Kiaan Kapur—along with Sunjay Kapur’s mother, Rani Kapur, had raised “suspicious circumstances” surrounding the alleged will. It further stated that the burden of dispelling these doubts rests on Priya Kapur, while clarifying that the genuineness and validity of the will will be decided during the trial.
Holding that a prima facie case had been established in favour of the plaintiffs, the High Court restrained Priya Kapur from transferring, selling, pledging, or altering the equity structure or shareholding in Sunjay Kapur’s Indian companies. She has also been barred from withdrawing provident fund amounts and from disposing of personal belongings, artworks, or cryptocurrency assets linked to the deceased.
The court further prohibited withdrawals from certain specified Indian bank accounts, except for payments necessary to discharge liabilities owed to the children under the divorce settlement between Sunjay Kapur and Karisma Kapoor. It also imposed restrictions on selected foreign bank accounts and crypto assets associated with the estate, while noting that it lacks jurisdiction over immovable properties located abroad and therefore issued no directions regarding them.
The dispute stems from a civil suit filed by Samaira and Kiaan Kapur, who are seeking a share in their late father’s personal estate, estimated to be worth around ₹30,000 crore. The siblings have challenged a will dated March 21, 2025, which allegedly bequeaths the entire estate to Priya Kapur. They have termed the document forged and alleged that it is the result of a criminal conspiracy aimed at excluding them and their grandmother from inheritance.
During earlier hearings, counsel for the children had argued that the will was allegedly tampered with while Sunjay Kapur was on holiday with his son. It was also alleged that an individual involved in modifying the document was appointed as a company director shortly after his death, raising further suspicion about the circumstances surrounding the estate planning.
The children have claimed a one-fifth share each in the estate, asserting their rights as Class-I legal heirs. They have also stated that they maintained a close relationship with their father, regularly meeting him and staying in touch through holidays and electronic communication.
Sunjay Kapur, former husband of Karisma Kapoor, passed away in June 2025 at the age of 53 after reportedly suffering a heart attack while playing polo in the United Kingdom.
In a connected defamation matter, the Delhi High Court has also directed Priya Kapur and Sunjay Kapur’s sister, Mandhira Kapur Smith, to refrain from making public statements against each other. Justice Mini Pushkarna, while hearing a civil defamation suit filed by Priya Kapur seeking ₹20 crore in damages, orally observed that both parties must maintain dignity and exercise restraint in public remarks until further proceedings.
