As India has taken the battle to the opposition indulged in petrifying its borders, amidst the political blame game that the largest economy has shunned humanity, and is less resilient to Islam religion; the most learned correctional judiciary system has demonstrated its centuries old delivering justice – a cornerstone of democracy, playing a crucial role in upholding the rule of law and ensuring the citizens’ rights.
When the Indian Defence was counterfeiting all possible terror strike, by the radical Pakistan & its sponsored Lashkar E Taiba (LeT), Jaish E Mohammed (JeM), along with eradicating Terrorism from its roots, the Central Government granted Indian citizenship to the widow of Pahalgam terror attack victim Bitan Adhikary.
Mrs. Sohini Roy, the widow of West Bengal resident Bitan Adhikary, one of the 26 tourists killed in the Pahalgam terror attack has been granted Indian citizenship by the Union Ministry of Home Affairs, putting an end to the longstanding controversy over claims that she was originally a Bangladeshi citizen. The citizenship controversy surrounding Sohini Roy surfaced after Bitan’s family members alleged that she was originally a Bangladeshi national who had been living in India illegally following her marriage to Bitan.
According to the certificate of registration issued by the Indian government, Sohini Roy was born in Fatullah, Narayanganj, Bangladesh in March 1989 and crossed into India in January 1997. She has been residing in India ever since. Her citizenship became the center of controversy, with widespread criticism on social media where there were allegations that Sohini was the cause of internal family disputes, and Bitan’s family went so far as to blame her for his death. Additionally, it was alleged that Sohini concealed her identity while marrying Bitan, an IT professional, and that she possesses two different birth certificates. Based on these claims, the family argued that Sohini should not be legally entitled to any government compensation following Bitan’s death.
In another incident, the Bombay High Court has granted bail to a female Bangladeshi national, accused of illegally entering India, citing violation of her fundamental rights due to her delayed production before a magistrate.
In an order passed on 07th. May, Justice Milind Jadhav noted that petitioner was not produced within the mandatory 24-hour period after her arrest, which amounts to a breach of her constitutional rights under Articles 21 and 22. The court observed that Shabnam Suleman Ansari, a resident of Vashi, was arrested on January 28th. at 12.30 pm, along with her one-and-a-half-year-old son. However, she was presented before a magistrate only at 4.30 pm the very next day, which was well beyond the 24-hours window.
“The production of applicants thus beyond the permissible limit of 24 hours is in clear violation of fundamental rights guaranteed under Articles 21 and 22 of the Constitution of India”, Justice Jadhav reiterated. “Prima facie this is an unexplained breach of the mandate of Article 21 and sub-clause 2 of
Article 22 of the Constitution of India”.
While delivering the verdict, the judge came down heavily on the investigating officers, stating, “It is unfortunate that prosecution officers are indifferent to these elementary but statutory requirements regarding detention beyond 24 hours not being permissible unless the accused person is produced before the Magistrate”.
Shabnam Suleman Ansari was arrested based on intelligence inputs that a foreigner had entered India illegally. She was booked under Section 14(a) of the Foreigners Act, 1946 and Sections 3(a) and 6(a) of the Passport (Entry into India) Act, 1950 at APMC Police Station. Her advocate, Shubham Upadhyay, argued that the delay in production violated Section 58 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which was accepted by the high court and the court granted her bail.
